Terms and Conditions Harz Eco Lodges

Harz Eco Lodges is a vacation park located at Straße des 20. Juli 1, 37441 , Bad Sachsa, Germany. These General Terms and Conditions apply to all offers, reservations and contracts relating to all accommodations and other facilities, which are rented by Harz Eco Lodges.

 

Article 1. Definitions

1. Tenant - the person who enters into a contract with Harz Eco Lodges regarding the rental/use of an accommodation.
2. Co-renter - the person who stays in the accommodation together with the (main) tenant.
3. Third party - any other person, not being the tenant or co-tenant.
4. Accommodation - a vacation home offered for rental by Harz Eco Lodges.
5. Contract - the contract for rental of an accommodation with the associated General Terms and Conditions.
6. Reservation - a booking accepted by Harz Eco Lodges for an accommodation.
7. Stay - the actual use of the accommodation for vacation purposes.
8. Rent - the fee paid for the use of the accommodation.
9. Cancellation - the termination of the contract by the tenant, before arrival date of the stay.
10. Park regulations - the regulations applied by Harz Eco Lodges for the vacation park.

 

Article 2. Right of withdrawal

Harz Eco Lodges reminds the tenant that reservations made by the tenant are legally final. A right of withdrawal (the so-called reflection period) of 14 days, does not apply to contracts concluded with Harz Eco Lodges.

 

Article 3. Applicability of general terms and conditions

These General Terms and Conditions apply to all contracts between Harz Eco Lodges and the tenant concerning the rental of accommodation. These terms and conditions form an indissoluble part of the contract.

 

Article 4. Formation of contract and reservation

1. The contract for the rental of an accommodation at Harz Eco Lodges is concluded when Harz Eco Lodges confirms the reservation to the lessee.
2. The contract can be concluded at the reception of Harz Eco Lodges, by telephone or through an (online) reservation. A contract can only be entered into by a tenant who is 21 years of age or older. If the co-tenants are under 21 years of age, the tenant must accompany the co-tenants for the entire stay. Reservations made by persons under 21 years of age are not valid.
3. Harz Eco Lodges reserves the right to refuse non-standard reservations, especially groups, or to impose special conditions on them without giving reasons. Youth groups are not allowed to stay in the accommodations.
4. If Harz Eco Lodges accepts a reservation, Harz Eco Lodges will send the tenant a reservation confirmation (invoice). If the reservation confirmation is not received by the tenant within 5 days of making the reservation, the tenant must contact Harz Eco Lodges. Earlier, the tenant cannot claim the reservation.
5. Tenant must check the reservation confirmation for accuracy immediately upon receipt. Any inaccuracies in the booking confirmation must be communicated to Harz Eco Lodges within 24 hours.

 

Article 5. Changes to the contract

1. If, after the contract is concluded, the tenant wishes to amend the contract, Harz Eco Lodges shall not be obliged to accept the amendments. In the event that Harz Eco Lodges accepts the changes, Harz Eco Lodges may charge an amendment fee if these changes are requested 28 days or less before the start of the stay.
2. Change of arrival date from 28 days before arrival is not permitted. In this case, the cancellation fees as described in Article 8 of these Terms and Conditions will apply.
3. In the unlikely event that the accommodation booked by the tenant is not available, Harz Eco Lodges is entitled to provide the tenant with equivalent, replacement accommodation. The tenant is not entitled to any compensation or discount.
4. The tenant is not permitted to hand over the accommodation to anyone other than the persons named in the contract, unless otherwise agreed in writing with Harz Eco Lodges. If the tenant and Harz Eco Lodges have agreed to change one or more tenants, the original tenant shall remain jointly and severally liable to Harz Eco Lodges for payment of the outstanding portion of the rental fee and any additional costs incurred as a result of the change, replacement and or cancellation.
5. Harz Eco Lodges is entitled to terminate the contract with immediate effect at any time if, when booking, personal details of the tenant and/or co-tenants are incomplete and/or incorrect. In such a case, there will be no refund of the rental price or any part thereof.

 

Article 6. Prices and rates

1. The lessee shall owe Harz Eco Lodges the agreed rental price as stated in the booking confirmation (invoice).
2. Rental prices are starting prices including VAT and mandatory additional costs, excluding optional additional costs. Mandatory additional costs consist of costs for final cleaning, bed linen, towels, kitchen towels and tourist tax. Optional additional costs are costs for additional purchases such as additional bookings and/or activities.
3. Discounts and/or special offers can no longer be used once the booking confirmation has been sent by Harz Eco Lodges.
4. Harz Eco Lodges is entitled to pass on and offset any price increases resulting from interim changes to statutory regulations or provisions (including but not limited to VAT, tourist tax, insurance tax) over which Harz Eco Lodges has no influence.

 

Article 7. Terms of payment

1. Within 5 days of making a reservation, the tenant must make a deposit of 50% of the total amount payable. For reservations made within 6 weeks before the day of commencement of the stay, the full amount must be paid at once.
2. The remaining amount of the rental price must be received by Harz Eco Lodges no later than 6 weeks before the day of commencement of the stay, as stated in the reservation confirmation.
3. For a reservation made within 14 days before the start of the stay (last-minute), the total amount due must be paid immediately upon booking.
4. If Harz Eco Lodges has not received payments in time, Harz Eco Lodges shall be entitled to dissolve (cancel) the contract and hold the tenant liable for cancellation fees. Harz Eco Lodges reserves the right to offer the accommodation for rent again.
5. The key to the accommodation will not be issued until Harz Eco Lodges has received full payment for the reservation. To this end, Harz Eco Lodges may ask the tenant to provide proof of payment.

 

Article 8. Cancellation policy

1. A reservation can be cancelled free of charge up to a maximum of 30 days before the start of the stay (arrival date).
2. In case of cancellation within 60 days before arrival, cancellation charges will apply.
3. The cancellation fee for cancellation within 60 days prior to arrival is 100% of the net rental price plus any reservation fees.
4. If the tenant has not arrived within 24 hours of the agreed arrival date without further notice, this is considered a cancellation. In this case, the lessee will owe the total amount payable.

 

Article 9. Arrival and departure.

1. The rented accommodation can be occupied on the agreed day of arrival as stated on the booking confirmation from 3 p.m. onwards. Harz Eco Lodges has the option to change the arrival time to 4:00 p.m..
2. In the event of arrival outside the aforementioned time, the tenant must notify Harz Eco Lodges, no later than 3 p.m. on the day of arrival, that he wishes to occupy the accommodation at a later time.
3. Tenant, if requested, is obliged to identify himself at the "check-in". If the tenant cannot show proof of identity, Harz Eco Lodges may decide not to accept the tenant.
4. On the agreed day of departure as stated on the booking confirmation, the accommodation must be vacated by 11:00 am. Harz Eco Lodges shall never be responsible for the consequences of leaving later than the time indicated. In the event of departure at a later time than indicated in the reservation confirmation, the tenant will be required to pay a surcharge.
5. If the use of the accommodation is terminated earlier than the agreed date stated on the booking confirmation, the tenant is not entitled to a refund of (part of) the rental price and/or costs by Harz Eco Lodges. If the tenant has taken out travel insurance and the tenant meets the conditions set by the insurance company, the tenant has the option of submitting a claim for damages on account of early termination of the stay directly to the insurance company.

 

Article 10. Park regulations

1. The tenant must behave as a good tenant and use the accommodation in accordance with the following guidelines of Harz Eco Lodges.
2. Each accommodation may only be inhabited by the maximum number of persons listed on the Harz Eco Lodges website for the accommodation in question.
3. The tenant and co-tenants are required to rent bed linen from Harz Eco Lodges with the accommodation. It is not permitted to use own bed linen or beds without bed linen.
4. Garbage must be deposited packed in sealed bags in the designated container(s). The renter must keep the accommodation plot free of garbage.
5. It is not allowed to hang laundry, bedding or clothing visibly outside the accommodation.
6. The accommodations each have personal furnishings. It is not allowed to take furniture that belongs in the accommodation outside. (Garden) furniture may not be moved to other accommodations.
7. It is not allowed to operate the technical installations in the accommodation (such as WiFi and heating system) yourself. If this does happen, repair costs may be charged.
8. Digging holes and damaging public greenery is not allowed.
9. A pet (max. 1) may be brought only if agreed upon in the reservation and allowed in the rented accommodation. If this is not the case, refusal of the pet or rebooking to another accommodation may result.
10. Pets must be kept on a leash outside the accommodation. Pets may not cause a nuisance to other guests. For dogs, a dog basket must be brought. Visitors' pets are not allowed. When the tenant leaves the park, it is not allowed to leave a dog in and/or around the accommodation.
11. Smoking is not allowed in the accommodation. If this is observed, extra cleaning costs will be charged.
12. Barbecuing is not allowed in Harz Eco Lodges unless the facilities provided at the accommodation are used.
13. It is forbidden to make open fire and flame at Harz Eco Lodges.
14. The lessee is prohibited from causing nuisance to other residents of the park by making music or noise. Harz Eco Lodges reserves the right to address, refuse or remove tenant/groups in the event of any form of noise nuisance.
15. The rental of multiple accommodations by groups is only possible if a reservation is made as such stating the nature or composition of the group. Failure to register as such may result in termination of the rental agreement. Youth groups are not allowed.
16. The lessee is allowed to park a maximum of 1 car per accommodation in the designated parking lot. Parking in gardens and on lawns is prohibited. Visitors' cars are not allowed to park inside the park. Additional cars of tenants and/or visitors must be parked outside the park.
17. The renter is not allowed to enter the park with a vehicle longer than 5.5 m. Caravans, campers, trailers and/or tents are expressly prohibited at Harz Eco Lodges.
18. The lessee is not allowed to charge an electric car other than in the parking spaces provided and reserved for this purpose. If the lessee violates this rule, Harz Eco Lodges is entitled to charge for this.
19. The tenant is not permitted to place bicycles in or against the accommodation.
20. Charging of the disconnected battery of an electric bicycle must be done (indoors) in the accommodation, using a charger brought by the tenant.
21. When entering and leaving Harz Eco Lodges, the lessee is obliged to maintain a maximum speed of 5 km. per hour.
22. In view of emergencies and supply (of emergency services), paths, access roads and the barrier must remain free of motor vehicles and other obstacles.
23. Between 11 p.m. and 7 a.m., the night's rest must be respected. The tenant is not allowed to enter the park with motorized vehicles between 11:00 p.m. and 7:00 a.m..
24. Public drunkenness is prohibited. The lessee is not allowed to have opened bottles and/or cans of alcoholic beverages outside the accommodation, other than on the accompanying terrace.
25. Upon departure, the lessee must leave the accommodation broom clean. This means: no dirty dishes left behind, bedding removed and folded, kitchen and refrigerator left clean, waste / garbage bags placed in the appropriate containers. Items present in the accommodation must be returned to their original place. Harz Eco Lodges is entitled to make a final check at the time of departure. If Harz Eco Lodges observes that the accommodation has not been left properly, Harz Eco Lodges is entitled to charge the tenant additional costs for this.
26. In the event of breach of one or more of the obligations listed in Article 10 item 1 to 25, Harz Eco Lodges reserves the right to remove the tenant without refund of the rental price or any part thereof.
27. If Harz Eco Lodges suspects that the tenant of an accommodation is acting in breach of the law and/or public order and/or morality, Harz Eco Lodges is authorized to access the accommodation.
28. The Harz Eco Lodges team reserves the right to enter the accommodation at any time for inspection and/or to carry out maintenance work (or have it carried out).

 

Article 11. Deposit policy

At Harz Eco Lodges we require a security deposit of €250 per reservation to ensure the quality of our accommodation. The deposit is paid automatically when making the reservation. After the stay, we will refund the deposit to the specified account within 5 working days, provided that the accommodation and facilities have been left in good condition.

In the rare case of damage or loss, we will always contact you first. After careful investigation and in consultation, it may be decided to withhold all or part of the deposit to cover the costs. Thus, together we ensure a high-quality experience for all guests of Harz Eco Lodges.

 

Article 12. Liability

1. Harz Eco Lodges is not liable for theft or damage to the tenant's property during or as a result of a stay at Harz Eco Lodges.
2. Harz Eco Lodges is not liable for nuisance caused by third parties.
3. Harz Eco Lodges is not liable for service failures or defects in services provided by third parties.

 

Article 13. Complaints

Despite the care taken by the Harz Eco Lodges team, the tenant may have a justified complaint regarding the accommodation/holiday park. The tenant must report this complaint immediately to the reception of Harz Eco Lodges. Should the complaint not be handled to the satisfaction of the tenant, the tenant has the opportunity to submit the complaint in writing within 30 days to info@harzecolodges.com with reservation number, dates of stay, name, address and accommodation number. The complaint will then be dealt with.

Article 15. Applicable law

The contract between the tenant and Harz Eco Lodges is exclusively governed by German law.
